TERMS OF USE & ACCEPTANCE OF TERMS

BCASParamedics.com (BCASP) provides a service to keep BCASP informed and in touch with one another. In this document those services will be referred to as "the Service" and the policies written in this document are the "Terms". These Terms may be changed by the BCASP owner at any time with or without notice to you. For the most up to date copy please view this URL periodically. By using the Service in any way, you are agreeing to comply with these Terms.

CONTENT

You understand that all postings, messages, text, files, images, photos, or other materials ("Content") posted on, transmitted through, or linked from the Service, are the sole responsibility of the person from whom such Content originated.

You are entirely responsible for all Content that you post, email or otherwise make available via the Service.

You understand that BCASP does not control, and is not responsible for Content made available through the Service, and that by using the Service, you may be exposed to Content that is offensive, indecent, inaccurate, misleading, or otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content, that you may not rely on said Content, and that under no circumstances will BCASP, the administrators or the moderators be liable in any way for any Content or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed or otherwise made available via the Service.

You acknowledge that BCASP does not pre-screen or approve Content, but that BCASP shall have the right (but not the obligation) in its sole discretion to refuse, delete, edit or move any Content that is available via the Service, for violating the letter or spirit of the Terms or for any other reason.

You acknowledge and agree that BCASP may, in its sole discretion, preserve or disclose Content, as well as email addresses, IP addresses, timestamps, and other user information, if required to do so by law or in the good faith belief that such preservation or disclosure is reasonably necessary to: comply with legal process; enforce the Terms; respond to claims that any Content violates the rights of third-parties; or protect the rights, property, or personal safety of BCASP, its users or the general public.

You agree that you are solely responsible for any 3rd party content that you may post in these forums. Please cite your source when posting content which has been written by others.

LIMITATIONS OF SERVICE

You acknowledge that BCASP establishes limits concerning use of the Service, including the retention period of the Content, and size limits on postings, email messages, or other Content that may be transmitted or stored by the Service. You agree that BCASP has no responsibility or liability for the deletion or failure to store any Content maintained or transmitted by the Service.

You acknowledge that BCASP reserves the right at any time to modify or discontinue the Service (or any part thereof) with or without notice, and that BCASP shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

You agree that BCASP, in its sole discretion, may delete your profile, block your email, username, IP address, or otherwise terminate your access to or use of the Service (or any part thereof), immediately and without notice, and remove and discard any Content within the Service, for any reason, including, without limitation, if BCASP believes that you have acted inconsistently with the letter or spirit of the Terms. Further, you agree that BCASP shall not be liable to you or any third-party for any termination of your access to the Service. Further, you agree not to attempt to use the Service after said termination.

PRIVACY

BCASP will collect an IP address from every user who posts on the board. If a user chooses to register a profile, a valid e-mail address will also be collected. All other information users may supply is voluntary.

The IP address and e-mail address are not visible to other users of the board. They are, however, visible to the moderator. Therefore no poster should assume they are anonymous even if they do not provide any identifying information. The IP address collected may be used by BCASP to track down perpetrators in cases where these Terms are violated.

"Cookies" are used by the board to identify repeat visitors. They are stored on your own computer, not the BCASP server, and are not used to collect information, track online activity, or any other privacy violating purpose.

BCASP will not disclose the information collected about posters under normal circumstances. They would certainly never be sold to any third party. The only exceptions would be legal or abuse-related cases as described in the section on Content.

ABUSE

Abuse is defined as any violation of these Terms. Please report any abuse to administrators.

BCASP reserves the right to take any actions necessary to rectify abuse and prevent it from reoccurring, such as removing Content, banning IP addresses, or using IP addresses to track down and report to ISPs.

ABUSE ACTION PLAN

Although we have taken great pains to ensure abuse does not occur, there are always going to be instances in which unacceptable behavior occurs. If you feel as though you have been abused by another member, please report the incident to the administrator. This option is a link at the top of the post box, or you may email the moderator/administrator. Please remember that "disagreeing" is not "abusing" and that the administration and moderation team have lives outside of the Internet.

Reports of abuse or offensive behavior will be investigated and the following actions carried out:

We will follow a "three strikes plan". Posts that require moderator intervention will constitute a "strike". After three strikes you will be suspended. After three suspensions you will be banned.

Incidences of foul language or posting personal information will be edited without warning.

Personal attacks on any other member of BCAS, regardless of who they may represent (management or union) will not be tolerated. Such attacks will be deleted without notice and will constitute a strike.

Incidences of behavior that contradicts the rules of conduct as noted above under the section "Code of Conduct" will be investigated on a case by case basis. If you find a post offensive, you need to report it in order to garner action - posts do not report themselves. If a post is reported, investigated and found to go against the terms of use as laid out here, members will be sent a PM asking them to edit the offending portion. They will be given a time limit. If they choose not to respond, the post will have the offending portions removed. Having a post reported, investigated, and found to go against the TOU will constitute a strike.

If you report a post to the administrator / moderator be aware that the administrator or moderator may investigate the post in question and find it to be perfectly okay. The reporting of a post does not constitute a strike on the part of the poster - it constitutes an investigation.

Our forums are powered by phpBB (hereinafter “they”, “them”, “their”, “phpBB software”, “www.phpbb.com”, “phpBB Group”, “phpBB Teams”) which is a bulletin board solution released under the “General Public License” (hereinafter “GPL”) and can be downloaded from www.phpbb.com. The phpBB software only facilitates internet based discussions, the phpBB Group are not responsible for what we allow and/or disallow as permissible content and/or conduct.
